Terms of Service
These terms are an agreement between you and Bearywell ("we", "us") covering your use of the Bearywell app and the bearywell.com website (together, the "Service"). By creating an account or using the Service, you agree to them.
1. What Bearywell Is — and Is Not
Bearywell watches for signs of your normal phone use and, if your day goes unusually quiet, checks in with you and can notify the trusted contacts you choose. It is a wellness and peace-of-mind tool.
Bearywell is not an emergency service, a medical device, or a substitute for one. It does not call 911 or any emergency dispatch, it cannot detect falls, accidents, or medical events, and alerts can be missed or delayed — for example if a phone is off, unpaid, out of battery, out of coverage, or if a notification is not seen. Never rely on Bearywell as your only safety arrangement. In an emergency, call your local emergency number.
2. Your Account
You need an account to use the Service, and you must give accurate information and keep your sign-in method secure. You must be at least 18 to create an account. You are responsible for activity that happens under your account.
3. Care Circles and Trusted Contacts
Bearywell is built around inviting people you trust. Only invite people who have agreed to be part of your care circle, and only add a loved one with their knowledge and consent. Members of a circle can see check-in status information about the protected person in that circle — that is the point of the product — so choose your circle thoughtfully. You can remove contacts, pause protection, or delete your account at any time.
4. Subscriptions and Billing
The core safety loop — one protected person plus one trusted contact — is free. Bearywell Pro unlocks additional trusted contacts and family features, sold as an auto-renewing subscription billed through your Apple ID.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends, at the price shown at purchase.
- You can manage or cancel your subscription any time in your device's Settings » Apple ID » Subscriptions. Deleting the app does not cancel a subscription.
- A Pro purchase covers every member of the circle it was bought for. If a subscription lapses, we never remove existing circle members or stop alerts to them — expiry only limits adding new ones.
- Refunds are handled by Apple under Apple's terms.
5. Acceptable Use
Don't misuse the Service: no unauthorized access, no scraping, no interfering with its operation, no using it to monitor a person without their consent, and no reselling it. We may suspend or close accounts that break these rules or abuse other users.
6. Your Content and Our Rights
You keep ownership of information you put into the Service. You give us the limited license needed to operate it — storing your profile, showing your check-in status to your circle, and delivering alerts. The Service itself, including its design, code, and branding, belongs to us.
7. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for any harm arising from a missed, delayed, or false alert. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
8. Ending Service
You can stop using Bearywell and delete your account at any time from inside the app; deletion removes your profile and the data described in our Privacy Policy. We may modify or discontinue the Service with reasonable notice.
9. Changes to These Terms
If we make material changes, we'll notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
